There have been reports circulating in the past two days about a civil action filed on 19 July 2021, America’s Frontline Doctors, et al vs Xavier Becerra, Secretary of the US Department of Health and Human Services, et al, that includes a whistleblower testimony claiming that there are at 45,000 deaths caused by the vaccine. (I will comment on that further below.) It is a preliminary injunction where the plaintiffs are:
…seeking first and foremost the revocation or termination of the declared emergency and existing Vaccine EUAs, and not for anti-competitive purposes, but in order to respond to unlawful agency action driven by financial conflicts of interest, political pressure and fear, the substantial risk of widespread personal injury and death, and constitutional infractions.
The document is 67 pages long and does not include the exhibits. The “Summary of Facts” that spans approximately 40 pages serves as a decent summary of what commentators and observers, even here at Opinyuns, have mentioned for months. It in effect covers, amongst other things, that:
the fatality rates do not support an “emergency”
up to 97% of PCR test results are false positives
asymptomatic transmissions are non-existent
the “vaccines” have not gone through the proper trials
the vaccines “were only shown to reduce symptoms—not block transmission”
if vaccines merely reduce symptoms but asymptomatic transmissions are non-existent, then vaccines, masking and lockdowns of the healthy are unnecessary
the mRNA vaccines do not conform to the traditional mechanism of using dead or live-attenuated versions of the disease
the generated spike proteins do not remain at the vaccination site and circulate the body, accumulates in a number of tissues and can also cross the blood-brain barrier and cause brain damage
the spike proteins are similar to naturally occurring proteins in sperm, ova and placenta so any antibodies raised against these spike proteins may have detrimental effects on the reproductive system
antibodies created by the vaccine can result in a more severe case of the disease, known as Antibody Dependent Enhancement (ADE)
more virulent strains can be created as a result of the vaccine
there are safer and more effective alternatives to the vaccines, such as HCQ and Ivermectin
the vaccines are merely authorized by the FDA for emergency use
those who have recovered from COVID-19 have a natural immunity stronger than what the vaccine can provide
contrary to normal immunology, the public is misled that immunity diminishes over time when it is the opposite
healthcare professionals and the public “are not adequately informed” regarding the vaccines
children are generally not at risk of a severe or fatal case of COVID-19 and therefore should not be subjected to the risks of vaccination
fear is used to manipulate the public, citing social psychologist Dr Alfred Biderman’s research from 1956, who studied techniques employed by the communist captors to induce individual compliance from USAF POWs during the Korean War.

Specifics are mentioned with references or citations. The above are simply generalized points.
As for the whistleblower’s claims, her declaration is not included, only that the general claim is mentioned. Referred to as “Jane Doe”, she is…
…a computer programmer with subject matter expertise in the healthcare data analytics field, and access to Medicare and Medicaid data maintained by the Centers for Medicare and Medicaid Services (CMS). Over the last 20 years, she has developed over 100 distinct healthcare fraud detection algorithms for use in the public and private sectors. In her expert opinion, VAERS under-reports deaths caused by the Vaccines by a conservative factor of at least 5. As of July 9, 2021, VAERS reported 9,048 deaths associated with the Vaccines. Jane Doe queried data from CMS medical claims, and has determined that the number of deaths occurring with [sic] 3 days of injection with the Vaccines exceeds those reported by VAERS by a factor of at least 5, indicating that the true number of deaths caused by the Vaccines is at least 45,000. [Emphasis original.]
It will be very interesting to see how this number was obtained. It is plausible since it is “estimated that VAERS only captures 1% to at best 10% of all vaccine adverse events.” But this latter statement itself is difficult to prove.
However, as a starting point, if recent data shows approximately 1 adverse event per 750–1,200 doses in the US compared to approximately 1 adverse event per 250 doses in the UK and Australia, then it seems that people in the UK and Australia are more likely to report their problems and/or have better reporting systems. In that sense, the US figures being off by a ballpark factor of 5 is plausible.
If people do not report problems, then I am not sure how one can prove the numbers are actually low. One can infer (but not necessarily deduce) a lot from checking the death registry and hospitalizations and run comparisons to figures before the plandemic started. Of course, if the reporting system is rigged, then the data is there somewhere. This document does not explicitly state that is the case, so it will be interesting to see the supporting evidence for the claim.
